Bad Frog Beer won't be hopping onto store shelves in New York soon.
A federal judge has ruled that the state can ban Bad Frog Beer based on its label, which depicts a frog making an obscene gesture with its finger.
The state Liquor Authority has twice rejected Bad Frog's bid to sell beer in New York based on the symbol, which is emblazoned with the slogans "Flip The Bird, Get a Frog," and "He Just Don't Care." The brand is sold in 22 states.
Bad Frog Brewery Co., based in Rose City, Mich., had argued among other things that the state was violating the company's right to free speech.
