Samuel LaRusso, an Akron trucker, has accepted a $440,000 pretrial settlement from a Newburgh company for the severe arm fracture he suffered four years ago when he fell off a poorly built loading dock.

LaRusso, 39, should receive the money in several weeks from insurance carriers for Highland Ice Cream Corp. of Newburgh, according to his attorney, Robert J. Maranto Jr.

LaRusso, who was working for the Perry Ice Cream Corp., was unloading a shipment on the Highland company's loading dock at about 8 a.m. Aug. 19, 1992, when a section of the dock gave way, and he fell about four feet, breaking his right arm, Maranto said.

LaRusso was out of work for nearly a year becauses he had to have his arm operated on three times.
