Your house and property are most likely the largest investments you will ever make. How do you know exactly what you have purchased or where your property lines lie?

When you went to the real estate closing at the county hall, you were given a property survey of the land you had purchased. It was prepared by a licensed land surveyor, examined by the seller's attorney, your attorney, the bank's attorney and probably a title insurance company. You have every right to believe you have a complete and accurate survey of your property.

Upon inspection of your new home and property, you are unable to find anything indicating where your property corners are. Upon calling your attorney or the land surveyor who performed the survey, you are told the surveyor never staked your property corners because it was not required by the current Land Surveyor's Standards as approved by the Niagara Frontier Land Surveyor's Association.

Effective January 1, 1991, all property corners are to be staked. The Niagara Frontier Land Surveyor's Association has adopted a revised set of land surveying standards requiring staking of property corners with iron pins or iron pipes of 1/2 inch diameter or larger, unless prevented by a physical obstruction.

This change will assist the new land owners in identifying their property boundaries and will also help them when mowing lawns, planting trees or shrubs, erecting fences or sheds, etc.

If you are planning to purchase property after January 1, 1991, make sure your attorney insists that the survey you receive is performed in accordance with the revised code of practice for land surveys as approved and adopted by the General membership of the Niagara Frontier Land Surveyor's Association.
