MAN BEATEN BY TROOPER GETS $87,000 IN DAMAGES

Court of Claims Judge Peter A. McCabe Jr. has awarded $87,000 in damages to Randolph J. Roda of Otisville, who was beaten by a state trooper during an arrest.

McCabe said that Roda had provoked Trooper Michael Greco but ruled that the provocation did not warrant an assault. He awarded Roda $500 for false arrest and $86,884.79 for his injuries and lost wages. The incident began July 24, 1988, when Greco and Trooper R.G. McCoy arrested him at the Orange County Fairgrounds in Wallkill, charging him with public lewdness for allegedly urinating in public view.

Roda claimed Greco butted him with his head, fracturing a bone near his eye, struck him several times and knocked him to the ground. Greco said that Roda was trying to escape, but McCabe ruled that Greco used more force than necessary to prevent an escape.
