Gov. Cuomo refused Wednesday to extradite four executives of a New York-based blue-movie satellite broadcasting company to face obscenity charges in Alabama.
In a letter to Alabama Gov. Guy Hunt's legal staff, Cuomo counsel Evan Davis said New York law does not allow the governor to comply with such an extradition request unless the alleged offense is also a crime in New York.
The March indictments name Home Dish Only Satellite Network Inc., four of its executives, the giant GTE Corp. and some of its executives. The charges resulted in Home Dish's American Exxxstasy channel and its related Tuxxedo channel being pulled off the air.
The indictments set off a debate over censorship in the high-tech era because the action in Alabama ended up cutting off the movies to subscribers nationwide.
