DELICATESSEN OWNER FACES STATE TAX-LAW CHARGES

An Ontario Avenue delicatessen operator has been charged with violating two sections of the state tax law by selling untaxed cigarettes.

Ferby Everett, 32, of 1124 Linwood Ave. was arraigned Thursday in City Court to answer an appearance ticket issued Jan. 11 by Enforcement Officer Michael Packard of the State Tax Commission.

City Judge Mark Violante granted him an adjournment until Feb. 14. He was charged with unlawful possession of unstamped cigarettes and making a willful attempt to avoid the tax. Everett, according to the complaint, purchased 522 packages of unstamped cigarettes from Smokin' Joe's on the Tuscarora Indian Reservation and offered them for sale at the F & M Delicatessen.
