Lawyers for the parents of a Buffalo foster child Monday began legal action against Erie County in the suspected fatal beating of their daughter.
In a notice of claim for unspecified financial damages, Benneitha Tann and Richard Cottom accused the county and its Social Services Department of putting their daughter, Radsheyon, 4, in a foster home that was "dangerous and hazardous." Such a claim is the first step required in a suit against a municipality.
From the time she and her 5-year-old sister were placed in a Jefferson Avenue foster home last June 9, Radsheyon "was beaten and abused," and county child-protection workers failed to investigate complaints by her parents, the claim stated.
The Erie County district attorney's office and Buffalo police are investigating Radsheyon's Nov. 24 death of severe head injuries as a homicide, but so far they have identified no suspects.
