Detective Lt. Richard Clute said today further charges are not anticipated following the death of a local man in the Erie County Medical Center late Monday.
Gary Townsel, 30, of 2626 Main St. was confined to the hospital's physical trauma unit with severe head injuries and at one time was declared brain dead after he was struck twice on the head with an iron barbell following a dispute Dec. 12 at the City Mission on Buffalo Avenue here.
Frederick Gary, 21, a mission resident at the time, was charged with first-degree assault in connection with the attack. But Clute said today Gary was not charged by a grand jury.
"I plan to confer with the district attorney, but it would appear no further charges will by lodged," said Clute, head of the Homicide Squad.
Gary, a native of Huntsville, Ala., had been staying at the mission after serving 21 days in the Niagara County Jail on a petit larceny charge. He told police he returned to his room at the mission and Townsel attacked him following a discussion before he took the barbell away from the victim and struck him.
