A SUNY Fredonia student has been indicted on charges of surreptitiously video recording two young women changing in and out of their bikinis at a hot tub party in the Town of Lockport in August 2013.
Alberto Gonzalez, 23, pleaded not guilty Wednesday before Niagara County Judge Sara Sheldon to 12 counts of unlawful surveillance and disseminating unlawful surveillance.
Gonzalez allegedly sent the videos to Timothy D. Laubacker, said Assistant District Attorney Cheryl L. Grundy. Laubacker last month was sentenced to 15 years in a federal child pornography case.
Gonzalez allegedly recorded the women through a bathroom window. The girls were old enough so the videos would not be considered child porn. Gonzalez was interviewed by police as a potential witness against Laubacker but became a suspect when police learned he allegedly recorded the women, Grundy said.
The existence of the videos was disclosed in U.S. District Court during Laubacker's August 2016 bail hearing, but they were not part of the indictments obtained against him or against Travis Guerriera, 27, of Olcott. The latter shared images of nude Newfane High School girls with Laubacker and is awaiting sentencing in federal court for cyberstalking and possession of child porn.
Laubacker, 26, pleaded guilty to trying to force a young woman, who had already given him nude photos of herself during their years together at Newfane, to send him more nudes. He also admitted obtaining nude photos from a 13-year-old girl he met when she was a patient in the Eastern Niagara Hospital mental health unit and he was an employee there.
