Eden man arraigned on charge of burglarizing house that burned

An Eden man was arraigned Monday in Erie County Court on charges related to a break-in at a Hamburg home the same night that house burned in a fire.

Nicholas A. Harms, 31, was indicted on charges of second-degree burglary and criminal possession of stolen property. Harms was found nearby when the house at 95 Rosedale Ave. in the Village of Hamburg burned on Aug. 22. Police say they found him with several items they believe were taken from the home, including a credit card.

Investigators say that a fire started in the home’s attached garage that same night and spread to the house. Five people living in the home escaped from a second-floor window.

Harms pleaded not guilty to the charges and was allowed to remain free on $100,000 bond.
