Erie County Legislator Patrick Burke intends to propose a local law banning smokers from smoking in their cars if there are child passengers.
The Buffalo Democrat is scheduled to announce the proposed law at Roswell Park Comprehensive Cancer Center. He said he has Roswell Park's support for the law.
“Children have no way of knowing the dangers of cigarette smoke and cannot be expected to protect their own health," Burke said in a statement. "We already do not allow smoking in indoor public spaces because we know the dangers of secondhand smoke. Why would exposing a child to conditions that can do irreparable damage to their health be any different?"
The City of Schenectady and Rockland County already have similar laws on the books, as well as several other states, Burke said.
