Family of Grand Island hit-and-run victim files lawsuit

The family of a Grand Island woman who suffered severe head trauma in a hit-and-run on Grand Island on June 13 filed a lawsuit Tuesday against the suspected driver as well as the Town of Grand Island and Erie County.

Dana Papaj, 54, has remained hospitalized at Erie County Medical Center since she was struck while walking her dog on the shoulder of East River Road.

The suit, filed in State Supreme Court, accuses Edward J. Kuebler III, a correction officer at Wende Correctional Facility and a volunteer firefighter, of fleeing the scene of the accident. Kuebler was charged Aug. 30 with leaving the scene of a serious personal-injury incident, a felony.

The family is also suing Grand Island and Erie County, alleging they failed to maintain the road and failed to have sidewalks where Papaj was struck.
