A state judge Monday denied former Buffalo School Board Member Carl P. Paladino's request for a temporary restraining order preventing the board from filling the vacant Park District seat he used to hold.
"I'm going to deny that because I think the greater harm is that no one will be representing the Park District," said State Supreme Court Justice Catherine Nugent-Panepinto.
Paladino was removed from the seat by state Education Commissioner MaryEllen Elia for revealing discussions that had taken place in executive session.
Paladino attorney Dennis C. Vacco was not seeking to have his client immediately reinstated as a board member, only to have the seat remain vacant until the entire matter is settled in court.
The School Board, meanwhile, was scheduled to conclude interviews with 15 candidates for the seat Monday evening, after which it could select the new Park District representative.
