Thirty North Tonawanda residents filed suit in State Supreme Court this week, seeking to overturn last month's approval by the city Planning Commission of a 64-unit condominium project at 1100 Sweeney St.
The suit, filed by attorney Richard J. Lippes, contends that the approval of the MCW Construction project violated state laws and the city's own zoning ordinance. It also says the project does not comply with the terms of North Tonawanda's comprehensive plan.
The complaint asserts that 16 four-unit buildings would be erected in a poor-drainage area and would increase sewer loads and vehicle traffic, despite assertions to the contrary from the developer's consultants.
The lawsuit demands a full environmental assessment of the project as well as review by the Niagara County Planning Board.
