A 33-year-old Buffalo man has pleaded not guilty in Buffalo City Court to a first-degree vehicular assault charge and two counts of DWI, according to the Erie County District Attorney's Office.
Authorities allege that Marshawn Levy on May 13, 2017, was driving northbound on Bailey Avenue at East Delavan Avenue while having a blood-alcohol content of .12 percent, almost twice the legal limit. He’s accused of striking a car that was stopped in the southbound lane to make a turn onto East Delavan.
The collision caused injuries to that car’s 27-year-old driver and a 25-year-old passenger. The passenger is still being treated for his injuries at Erie County Medical Center.
Bail was set at $5,000. If convicted of the charges, he faces up to seven years in prison.
