Muffler problem leads to felony drunk driving charge

A faulty muffler led to the felony drunken driving arrest of a Town of Alabama man by Genesee County sheriff deputies early Sunday morning.

John Paul Daley, 36, was pulled over on Alleghany Road about 12:19 a.m. After reportedly smelling alcohol on Daley, deputies asked him to take a breath test, but he refused. After a check on his records, he was charged with felony DWI because of a prior DWI conviction within the last 10 years.

Daley also was charged with refusing to submit to a breath test and having a muffler violation on his vehicle. During his arraignment in Alabama Town Court at 3:45 a.m. Sunday, he was denied bail and remanded to the Genesee County Jail in Batavia pending further court proceedings.
