Erie County Sheriff's deputies retrieved a loaded handgun after a traffic stop Tuesday at South Park Avenue and Smith Street in Buffalo.
After detecting the odor of marijuana and observing passengers with open alcoholic beverages, deputies conducted a search and seized a loaded .380 caliber handgun, which they determined had been stolen in 2015 from Clarence.
The driver, Tyree Sommerville, 43 of Buffalo, was driving with a suspended driver's license and had an outstanding warrant from Cheektowaga police, authorities said. Sommerville was charged with two felonies for criminal possession of a loaded firearm and criminal possession of a stolen firearm, as well as a misdemeanor count of aggravated unlicensed operation.
Two passengers, Antonio Henley, 24, of Tonawanda, and Devante Henley, 24, of Buffalo, were charged each with felonies for criminal possession of a loaded firearm, criminal possession of a stolen firearm and drinking alcohol in a vehicle.
The three remained in the Erie County Holding Center Tuesday night pending arraignment.
