Speeding, burning rubber get 3 arrested for DWI

Speeding and burning rubber got three men arrested by Orchard Park police in two incidents late Saturday and early Sunday.

In the first incident, Officer Gregory Sheppard pulled over a vehicle on Abbot Road for speeding at 10:14 p.m.  Driver Timothy Elvers, 36, of Orchard Park, appeared intoxicated and after field testing, was arrested, police said.  He refused a breath test at police headquarters and was ticketed for speeding, unsafe lane change, inadequate exhaust and driving while intoxicated.  He was released without bail and is due back in Orchard Park Town Court later in March.

Then, at 4:14 a.m. Sunday, Sheppard was on Abbott Road again when two vehicles pulled out of parking lot and spun out their tires causing a loud disturbance and smoke, police said..  The vehicles then went to the light at Abbott and Berg roads and when the light turned green, both cars did it again and appeared to be preparing to race.

The cars were pulled over and drivers  Jacob Smith and Kyle Hanna, both 19 and from West Seneca, were arrested for driving while intoxicated.  They were returned to police headquarters, where Smith registered .20 percent and Hanna registered .15 on blood alcohol contest tests, police said.   Smith was charged with aggravated driving while intoxicated and Hanna with driving while intoxicated.  They also were  charged with unsafe starting and unlawful speed contest. They were released to a parent and are due back in Orchard Park Town Court later in March.
