An Erie County grand jury has indicted a Buffalo man on charges he assaulted a 22-month-old boy in October, Town of Tonawanda police said.
Officers responded to a home on the 2600 block of Sheridan Drive on Oct. 5 for the report of an unresponsive baby, according to police.
The injured child was taken to Women & Children's Hospital and diagnosed with a subdural hematoma, swelling on the brain and a spinal cord injuries, police said.
Brooks initially told officers he was watching the child when he fell backwards down three stairs and struck his head.
Doctors told police the injuries suffered by the child were consistent with "shaken baby syndrome."
Brooks faces charges of first-degree assault, two counts of second-degree assault and reckless assault of a child. He is being held in the Erie County Holding Center.
