Five Guys Burgers location OK'd in Lockport

LOCKPORT - A new Five Guys Burgers and Fries restaurant, the first one in Niagara County, was approved Tuesday by the Town of Lockport Planning Board.

The 2,650-square-foot eatery, which also will have a patio, is to be constructed in an addition to an existing building owned by Benderson Development in the Home Depot Plaza on South Transit Road. The other tenants in the building - Empire Visionworks, White Rabbit Frozen Yogurt and GameStop - will stay put.

The Planning Board had delayed action for a month after Glen Miller, the owner of a strip plaza north of Home Depot, contended that the addition, which is to protrude 36 feet from Benderson's existing building, would block the view of the strip plaza for drivers heading past the plaza. Miller said he'll consider whether to challenge the board's decision in court.

Matthew J. Oates, a civil engineer for Benderson, said some small trees will be removed to improve the sight lines for Miller's plaza. He said work on the restaurant will begin as soon as a building permit is obtained, but the opening date depends on how much progress can be made during the winter.
