Kenmore man avoids jail in $34,000 metal theft

LOCKPORT - A former employee of Armstrong Pumps in North Tonawanda, who joined his brother in stealing $34,000 worth of metal objects from the plant, was placed on three years' probation Friday by Niagara County Judge Sara Sheldon because he came up with his half of the restitution tab.

Nicholas R. Pompeo, 40, of Ermann Drive, Kenmore, was allowed to plead guilty to a misdemeanor because he already paid $17,000 in restitution for the March 2015 thefts. His brother Anthony Pompeo, who was not an Armstrong employee, previously pleaded guilty to a misdemeanor in North Tonawanda City Court.

They stole brass, pipe fittings and other metals and sold them for scrap, according to the District Attorney's Office.
