Southtowns sex offender gets five years in prison

A previously convicted sex offender was sentenced Thursday to five years in state prison for forcing a 13-year-old girl to engage in oral sex last September.

Dejay Burdic, 30, of Olean Road, South Wales had been out of prison for 10 months when he agreed to give the young victim a ride on Sept. 19, 2015. Instead of taking her to her destination, he stopped in a parking lot in the Town of Hamburg and assaulted the girl.

Burdic got married a week after the incident but later fled to Texas alone. In February, when he was the subject of a Crimestoppers alert, he returned to his pregnant wife and was arrested Feb. 22.

Facing charges of criminal sexual act in the first and second degrees and endangering the welfare of a child, Burdic agreed to plead guilty in August to one charge of criminal sexual act in the second degree, a Class D felony.

According to the District Attorney’s Office, Burdic was convicted of assault in 2006 and of attempted rape of a person under age 15 in 2008, when he was 21. He also has a 2009 criminal conviction in the Town of Ashford for sexual misconduct.

In addition to the five-year prison term, Justice Penny M. Wolfgang ordered 10 years post-release supervision. Burdic also is barred from having any contact with the victim.
