A South Wales man and convicted sex offender admitted in State Supreme Court Wednesday morning that he forced a 13-year-old girl to engage in oral sexual conduct in September.
Dejay Burdic, 29, of Olean Road, was giving a lift to the victim, who was known to him, when he pulled into a parking lot in the Town of Hamburg and assaulted her on Sept. 19. He initially was charged with criminal sexual act in the first and second degrees and endangering the welfare of a child, but pleaded guilty to criminal sexual act in the second degree, a Class D felony. The plea agreement means the young victim will not have to testify at trial.
After the assault, Burdic fled to Texas and became the subject of a Crimestoppers alert in early February. He eventually returned to the area, where he had left his pregnant wife, and was arrested Feb. 22.
Burdic was familiar to the justice system before the September incident and spent much of the past decade in prison. According to the District Attorney’s Office, Burdic was convicted of assault in 2006 and of attempted rape of a person under age 15 in 2008, when he was 21.
He also has a 2009 criminal conviction in the Town of Ashford for sexual misconduct and was last released from prison in November 2014.
Justice Penny M. Wolfgang agreed to consider a sentence of five years in prison and 10 years post-release supervision when Burdic returns to court Sept. 19. He already is classified as a Level 3 sex offender, the highest level for those considered most likely to reoffend.
Defense attorney John Jordan requested that Burdic, who has shaved his head and grown a beard since his arrest, be kept for his safety in the Erie County Holding Center while awaiting sentencing rather than the Erie County Correctional Facility in Alden.
