Driver in fatal S-curves crash appears in court

The driver of a car that rolled over on the Delaware Avenue S-curves near Forest Lawn was arraigned Monday in Buffalo City Court on charges of second-degree vehicular manslaughter, second-degree vehicular assault and driving while intoxicated.

Dennis Xenos, 24, of Amherst had three passengers in his 2008 Infiniti when he crashed into a lightpole and a tree at 3:20 a.m. Friday. One of the passengers, Christopher Rizzo, 24, of the Town of Tonawanda was killed. A second passenger, Veronica Hager, 21, of Buffalo, was listed in serious condition in Erie County Medical Center, according to the District Attorney’s Office. Police said the third person in the car was not seriously injured.

Judge Joseph A. Fiorella set bail at $35,000 and suspended Xenos’ driver’s license.

A felony hearing is scheduled for 9:30 a.m. Wednesday. Assistant District Attorney Christopher M. McCarthy is prosecuting the case.
