Allegany County man charged with driving with 0.31 BAC

AMITY – A Village of Belmont man had a blood-alcohol content nearly four times the legal limit while behind the wheel on Saturday, according to State Police.

Michael E. Whitney, 45, was pulled over on Back River Road and refused field sobriety tests.

After being taken to the Amity barracks, Whitney registered a BAC of 0.31 percent, nearly quadruple the legal limit of 0.08 percent, State Police said. He was charged with aggravated driving while intoxicated.

He was ticketed and due in Amity Town Court on Sunday.
