Falls man charged with DWI after refusing breath test

LEWISTON – State Police charged a Niagara Falls man with DWI after he refused to take a field sobriety test and a breath test.

Troopers noticed a vehicle driving erratically and without headlights on Lewiston Hill about 1:14 a.m. Saturday morning. They noticed a strong odor of alcohol in the breath of the driver, Joshua Noworyta, 26. Noworyta refused to perform standardized field sobriety tests. He was taken into custody and taken to state police barracks, where he also refused a breath test.

He was charged with driving while intoxicated, reckless driving and driving without head lamps.

Noworyta was issued appearance tickets for Lewiston Town Court.
