Irving man pleads guilty to DWI on ATV

An Irving man who was intoxicated when he crashed his ATV on Christmas Day, seriously injuring his passenger, pleaded guilty in Erie County Court to second degree vehicular assault.

Lee Jimerson, 32, was driving his ATV carrying his girlfriend, Heather Rozler, 40, of Salamanca on Versailles Plank Road in the Town of Collins when Jimerson lost control of the vehicle on a straight section of road. The ATV crashed into a ditch and Rozler was thrown onto the asphalt, suffering a serious head injury. Neither rider was wearing a helmet. Rozler remains hospitalized.

A blood draw showed Jimerson had a BAC of 0.15 percent.

The Erie County Sheriff’s Office Accident Investigation Unit handled the case, which is being prosecuted by Assistant District Attorney Christopher M. McCarthy.
