City of Tonawanda police charged a man with aggravated driving while intoxicated for having a blood-alcohol level of .17 percent and having a 12-year-old in his vehicle.
Daniel J. Garner of the City of Tonawanda was pulled over early Tuesday morning on Main Street near the Town of Tonawanda line after crossing the center line and making a wide turn, police said.
Garner, 38, of Hinds Street, had a blood-alcohol content of .17 percent at the scene. He told police he was doing shots of cognac and had a bottle of it in the vehicle.
His 12-year-old nephew was in the vehicle with him, leading to charges of violating Leandra’s Law.
Garner was charged with aggravated DWI, consuming alcohol in a motor vehicle, making an unsafe turn and an unsafe lane change.
He was released on $750 bail and turned over to Buffalo police on an outstanding warrant.
