A Buffalo man who already is back in state prison for violating his parole was arraigned in State Supreme Court Tuesday afternoon on multiple charges of sexually assaulting a child.
David Rath, 35, pleaded not guilty to three counts of predatory sexual assault of a child, two counts of attempted rape of a child and one count of endangering the welfare of a child.
Justice John L. Michalski issued a temporary order of protection requiring that Rath have no contact of any kind with his alleged victim, who is under 13 years old.
Rath, who was returned to state custody in June, has five prior felony convictions, including burglary, attempted burglary and possession of stolen property, and two misdemeanor convictions. No date was set for his return to court.
