LOCKPORT – A man who was accused of taking photographs while he was having sex with a 16-year-old girl pleaded not guilty Tuesday in Niagara County Court.
Kenneth T. Mulcahy, 53, now of Meadville Road in the Town of Alabama, is named in a 20-count indictment accusing him of third-degree rape, second-degree coercion, four counts of third-degree criminal sexual act, two counts of child endangerment and six counts each of using a child in a sexual performance and promoting a sexual performance by a child. Both of the last two counts are deemed sexually motivated felonies, a factor that could increase the sentence if Mulcahy is convicted.
The incident with the girl allegedly occurred July 18 in Mulcahy’s home at the time on Jockey Road in Newfane. On Jan. 29, Theresa A. Ferguson, 54, now of Elmwood Avenue, Lockport, pleaded guilty to attempted third-degree criminal sexual act for allegedly holding the girl’s hand and comforting her as Mulcahy had sex with her. Ferguson faces a prison term of as long as four years for that felony.
Mulcahy, who remains free on $25,000 bail, has a tentative trial date of June 20.
