Falls man charged with DWI after being found asleep in toll booth lane

A Niagara Falls man faces a felony drunken driving charge after sheriff’s deputies found him asleep behind the wheel in an I-190 toll lane at the south Grand Island Bridge early Sunday.

Andrew Payton, 33, has a previous drunken driving conviction, according to the Erie County Sheriff’s Office.

At about 3 a.m. Sunday, Payton was charged with felony driving while intoxicated, operating a vehicle without an ignition interlock device, drinking alcohol in a vehicle, aggravated unlicensed operation, driving without a license, obstruction of governmental administration and being illegally stopped on a highway.

He was sent to the Erie County Holding Center on $25,000 bail pending an upcoming date in Tonawanda Town Court.
