Something didn’t smell right in Newfane Town Court

NEWFANE – The Town of Newfane courtroom is not a large courtroom so it was quite clear to a court officer Tuesday afternoon that one of the defendants in the courtroom reeked of the strong odor of alcohol.

The suspect had driven himself to court and according to sheriff’s deputies he had recently been arrested in Newfane for drunken driving.

Nicholas A. Lichtenthal, 40, of Applewood Lane, left the court at 4:30 p.m. and was arrested 30 to 45 minutes later in the 1600 block of Lockport-Olcott Road by Niagara County Sheriff’s deputies who once again charged him with driving while intoxicated and also drinking alcohol in a motor vehicle. He was found to have a blood alcohol of 0.17 percent, more than twice the legal limit. Deputies reported finding an open can of beer in the vehicle, along with numerous empty beer cans.

He is scheduled to return to court on the new charge on Oct. 6.
