Lockport man charged with felony DWI in Pendleton crash

LOCKPORT – A City of Lockport man pleaded not guilty Wednesday in State Supreme Court to a charge of felony driving while intoxicated and a lane violation, stemming from a June 13 one-vehicle crash in Pendleton.

Thomas J. Elberson Jr., 30, of Akron Street, was at the wheel of a truck that struck a utility pole on Bear Ridge Road.

Deputy District Attorney Theodore A. Brenner told Justice Richard C. Kloch Sr. that Elberson had told police he had consumed four beers and was driving home from a friend’s house when he fell asleep at the wheel of his truck. Elberson’s blood alcohol content was measured at 0.17 percent, more than twice the legal threshold for intoxication.
