Sheldon dismisses drug felony against Lockport man

LOCKPORT – Pleased with the success of a City of Lockport man in the judicial diversion program of court-supervised drug treatment, Niagara County Judge Sara Sheldon dismissed all charges against him Tuesday.

Mark D. Kahle, 44, of Bonner Drive, entered the program in June 2014, after pleading guilty to third-degree criminal possession of a controlled substance for having cocaine with the intention of selling it.

He was arrested Aug. 24, 2013, in a police drug raid on an apartment on Niagara Street in Lockport.

Participants in diversion normally are allowed to reduce their guilty pleas to misdemeanors with a nonjail sentence, but judges have the authority to dismiss all charges in cases where the defendant has done exceptionally well in the program.
