Prison for Falls man in knifing, sex cases

LOCKPORT – A Niagara Falls man was sentenced Friday to 1½ to three years in state prison for slashing a man with a knife and sexual misconduct with a woman.

Damien P. Powell, 41, of Pine Avenue, was sentenced by Niagara County Judge Matthew J. Murphy III for attempted second-degree assault and forcible touching. He won’t have to register as a sex offender because the latter charge is a misdemeanor and the woman was over age 18, Assistant District Attorney Robert A. Zucco said.

Powell knifed James Dolson in the Falls on New Year’s Eve 2013. The sexual incident occurred Jan. 20, 2014, the same night the same woman allegedly was raped by another man. A rape case remains open against Thomas S. Frazier Jr. 36, of Fifth Street in the Falls. Powell originally was accused of holding the woman down during the rape, but he denies that and did not plead guilty to that, defense attorney Michael S. Deal said.
