Cheektowaga couple remains jailed for severe injuries to weeks-old child

A Cheektowaga couple, who were arrested last Thursday in Erie County Family Court during proceedings involving their injured weeks-old baby son, remained in custody Wednesday evening at the Erie County Holding Center.

Paul Cole, 25, and Ashley Capitano, 22, were both remanded to the Erie County Holding Center by Cheektowaga Town Justice Paul S. Piotrowski on $30,000 cash bail each after they were both charged with endangering the welfare of a child and criminal possession of marijuana. Their infant child was found to have a fractured skull and other injuries by doctors at Women and Children’s Hospital when the couple took their 6-week-old son there late in March.

Cheektowaga police arrested the couple after consultations with the Erie County District Attorney’s Office. Police officials said doctors indicated that the infant, who was also hospitalized in March with broken ribs, a broken pelvic bone and a liver injury, may have permanent disabilities. There was no immediate explanation of how the child was injured.

The child is now in the custody of family members of the Strasbourg Drive couple.
