Proceedings on Fillmore council seat postponed

Uncertainty still surrounds the Democratic primary ballot for the Common Council’s Fillmore District following Monday’s postponement of Board of Elections proceedings until Thursday morning.

While incumbent Democrat David A. Franczyk survived objections filed to his designating petitions, challenger Samuel Herbert’s fate will be decided Thursday following a delay requested by candidate Joseph A. Mascia, according to Democratic Elections Commissioner Leonard R. Lenihan. Mascia and Franczyk had challenged the validity of Herbert’s petitions, Lenihan said, though Franczyk has since withdrawn his objections.

Herbert has filed 545 signatures on petitions requiring 500 valid signatures, and Lenihan said the board granted a “perfunctory” delay for Mascia to address the situation.
