West Seneca man pleads guilty to Falls sex crime

LOCKPORT – A former Niagara Falls resident now living in West Seneca pleaded guilty Thursday to having a 14-year-old girl send him a nude selfie.

David A. Nicoloff, 36, of Potters Road, West Seneca, was living on Willow Avenue in Niagara Falls at the time of the Aug. 31, 2013 incident. He pleaded guilty to attempted promoting a sexual performance by a child as a sexually motivated felony.

Niagara County Judge Matthew J. Murphy III told Nicoloff, who is currently in jail in Erie County as a probation violator, that he faces up to four years in state prison and 10 years of post-release supervision when he is sentenced Sept. 24.

The pre-indictment plea bargain also wrapped up a criminal contempt charge pending against Nicoloff in the Town of Niagara, Assistant District Attorney Cheryl L. Nichols said.
