Depew man charged with felony DWI after sobriety road check along Thruway

SILVER CREEK – A Depew man stopped for a sobriety road check along the Thruway was charged with a felony count of driving while intoxicated because he had a young passenger in his vehicle, State Police reported.

Andrew E. Baker, 33, was pulled over Sunday evening at Exit 58/Silver Creek-Irving. He was found to be intoxicated, police said, and a 12-year-old child was among the passengers in the vehicle.

Baker had a blood-alcohol content of 0.11 percent, police said. He was charged with a felony violation of Leandra’s Law because he had a passenger age 15 or younger.

The 12-year-old passenger was turned over to a sober party in the vehicle, police said. Baker was released to a sober third party after posting $250 bail; he’s scheduled to appear Monday in Hanover Town Court.
