Two men plead guilty to selling drugs in the Falls

LOCKPORT – Two men pleaded guilty in State Supreme Court Friday to separate drug-dealing indictments, and were admitted to the judicial diversion program of court-supervised drug treatment by Justice Richard C. Kloch Sr.

Tavio Burton, 39, of Cleveland Avenue, Niagara Falls, pleaded guilty to third-degree criminal sale of a controlled substance for selling crack cocaine May 6 in the Falls. Robert J. O’Toole II, 33, of Luther Street, Bergholz, admitted to fourth-degree sale for a hydrocodone and acetaminophen deal on Feb. 27, 2014 in the Falls.

Burton risks nine years in prison and O’Toole 5½ years for their felonies if they wash out of the program, which offers them no worse than a misdemeanor with probation if they become clean and sober.
