Attica man arrested after allegedly fleeing Bethany car crash

BATAVIA – A 32-year-old Attica man was captured hiding near a chicken coop at a wooded area outside of Bethany after his car allegedly crashed on Buckman Road in Bethany Saturday afternoon, according to the Genesee County Sheriff’s Office.

Authorities said Brian Allen Erbach then took his two children, ages one and two, to a nearby friend’s house before apparently trying to avoid capture.

Erbach was charged with felony counts of aggravated driving while intoxicated with a child – a known as Leandra’s Law – aggravated driving while intoxicated for having a blood-alcohol level over 0.18 percent and felony driving while intoxicated. He was also charged with child endangerment for having his two young children in his vehicle, speeding and moving between lanes unsafely. He faces further proceedings in Batavia Town Court later this week.
