Lockport sex offender imprisoned for sex video with 16-year-old

LOCKPORT – A registered sex offender who made a sex video with a 16-year-old girl on Valentine’s Day was sentenced Friday to seven years in prison, followed by 10 years of post-release supervision.

Niagara County Judge Sara Sheldon Farkas also warned Darwin J. Fifield Jr. that he might face civil confinement proceedings – a state attempt to put him in a mental institution – after his sentence is up.

Fifield, 35, of Church Street, Lockport, pleaded guilty to third-degree rape and attempted use of a child in a sexual performance. He was already rated a Level 1 sex offender for impregnating a 16-year-old babysitter in a Newfane mobile-home park in 2011. He served a year in jail for that after violating probation.

Deputy District Attorney Holly E. Sloma said Fifield, in a pre-sentencing interview with a probation officer about the latest case, “tried to justify what he did and blamed the victim for coming on to him.”

Sloma said of the girl, who was in court but didn’t speak, “I hope she can finally see Mr. Fifield for what he is: a sexual predator and a criminal.”

Assistant Public Defender A. Joseph Catalano said, “I don’t entirely disagree with Ms. Sloma’s assessment.” He said Fifield “didn’t understand what he did until he saw it on paper. … He doesn’t know why he did this. He knows he needs treatment.”

Fifield declined to address the court.

In another sex case before Farkas Friday, Leonard L. Sistrunk Jr., 20, of Linwood Avenue, Niagara Falls, pleaded not guilty to an indictment accusing him of forcible sex with a 13-year-old girl at a party in the Falls on the night of June 27-28.

Sistrunk denied charges of first- and second-degree rape.

Assistant District Attorney Robert A. Zucco said Sistrunk was on probation at the time for a Falls City Court conviction for violating a restraining order, “basically a stalking type of offense.”

Zucco said Sistrunk’s mother and a woman who had a child by Sistrunk were charged with beating up the 13-year-old girl July 3, the day Sistrunk was arrested.

Sistrunk’s mother, Kimberly Kennedy, 38, of Eighth Street in the Falls, pleaded not guilty Friday to second-degree assault and second- and third-degree intimidation of a victim or witness. An arrest warrant has been issued for the other woman, Cynthia Lidge, 38, of Pine Avenue, Niagara Falls, who has been indicted on the same charges as Kennedy.

Sistrunk was previously in the news for being shot twice Sept. 2 near the corner of Sixth Street and Pine Avenue, leaving a bullet lodged near his spine.

The shooter, Darrell L. Stewart, 32, of Cedar Avenue, Niagara Falls, is awaiting sentencing for attempted first-degree assault. Stewart’s half-brother, Ronald A. McClellan Jr., 27, of Cedar Avenue, is serving eight years in prison on the same charge. Prosecutors said McClellan had a “beef” with Sistrunk and urged Stewart to shoot him.
