MAYVILLE – Another juror was excused today, leaving no alternates to hear the evidence against Jason Wells in a Chautauqua County murder trial.

Wells, 37, has been charged with second-degree murder in the brutal slaying of his 81-year-old Fredonia neighbor, Ruth Fisk, in February 2010.

County Judge John T. Ward said,”Ladies and gentlemen drive carefully here to Mayville,” as he explained that the juror has been hospitalized and is not expected to return.

Defense attorney Lyle Hajdu asked that the trial be delayed to wait for the juror but the judge told the last alternate to step into the jury box and witness testimony resumed.

Two witnesses were called this morning. Jurors heard from former Jail Warden Patrick Johnson and a corrections officer.
