LOCKPORT – Niagara County prosecutors unsealed a new indictment Tuesday against Jose Rosario, 34, of Cottage Street, Lockport, who was accused of raping a woman last summer.
The superseding indictment includes all the previous charges against Rosario, plus second-degree assault as a sexually motivated felony, first-degree criminal sexual act and facilitating a sexual offense with the aid of a controlled substance.
Deputy District Attorney Holly E. Sloma said the new charges stemmed from the same incident with the same woman as in the original indictment. Rosario previously was charged with first-degree rape, sexual abuse and criminal sexual act in connection with an alleged Aug. 9 incident in the City of Lockport.
In another Lockport sex case before Judge Matthew J. Murphy III, a man who pleaded guilty to two child pornography felonies was sentenced to 10 years’ probation Monday.
John J. Troy Sr., 62, of Charlotte Street, admitted to promoting and attempting to promote sexual performances by children. A computer repairman found some 1,500 images on Troy’s computer, downloaded in 2010 and 2011.
