An Orchard Park man was charged with felony DWI Monday night after he attempted to drive his motor scooter drunk. It is his third DWI arrest in the past three years, police said.

Ronald Oliver, 60, was attempting to board his motor scooter in a restaurant parking lot around 9 p.m., but he kept falling off, Orchard Park police reported. When an officer arrived, he found Oliver lying in a puddle outside the restaurant, located on Abbott Road.

Oliver suffered cuts on his head and arm while falling off his scooter, police said. He could not stand up on his own and failed field sobriety tests, the officer reported.

Oliver’s DWI charge was upgraded to a Class D felony because he was convicted of DWI in 2011 and felony DWI in 2013. Police also charged him with a felony for aggravated unlicensed operation because he had lost his license due to his prior convictions.

He was also charged with four lesser charges: operating a motor vehicle without an ignition interlock device, no/improper helmet, no inspection and unregistered motorcycle.
