Father and son mull plea offer in stolen gun case

LOCKPORT – A Wilson father and son were given two weeks to consider a plea offer they received Tuesday in a stolen gun case.

Assistant District Attorney Peter M. Wydysh said Kevin S. Wise, 52, and Kevin S. Wise Jr., 23, of East Lake Road, may plead guilty to attempted third-degree criminal possession of stolen property, a Class E felony, in exchange for a recommendation of probation.

If convicted at trial, the younger Wise faces mandatory state prison time of at least 3 1/2 years, with a 15-year maximum.

The offer came as Niagara County Judge Sara Sheldon Farkas ruled that evidence gathered by undercover police, including an agent of the Bureau of Alcohol, Tobacco and Firearms, is admissible. The agent, wearing a recording device, caught the younger Wise on tape saying he wanted to buy some fully automatic rifles, including stolen ones, that the agent claimed to have.

The two Wises are accused of stealing numerous guns from a relative and having other guns that had been reported stolen. In a search of their home in November 2012, officers seized 31 weapons from the father and 14 from the son.
