Alden driver charged after .30 blood alcohol reading

An Alden man was charged with a felony count of aggravated driving while intoxicated Saturday night after deputies said his blood alcohol content was nearly four times the legal limit.

The aggravated DWI charge was filed against John P. Rogacki, 52, of North Millgrove Road, who was arrested after a traffic incident in Newstead around 11:15 p.m., the Erie County Sheriff’s Office reported.

Deputy Simon Biegasiewicz said he and State Police responded to Main Road in Newstead to investigate a complaint about a reckless driver. He said they pulled over an eastbound vehicle and questioned Rogacki, who submitted to a chemical breath test.

Rogacki’s blood alcohol content was measured at .30 percent, which is nearly four times the state’s legal limit, making his case an aggravated DWI, deputies said.
