Falls assault trial headed to jury today

LOCKPORT – A Niagara County Court jury will decide today whether Dennis C. Jeffrey struck a man in the side of the face with a golf club during a July 19 fracas on Ashland Avenue.

Jeffrey, 50, who is also known as Dennis Townsend, testified Monday that he was holding the golf club in his left hand and punched Jesus Portugues with his right hand, inflicting a cut near the man’s left eye and bending his eyeglasses.

Assistant District Attorney Ryan K. Parisi argued in his summation that a witness who was watching from across the street said Jeffrey had the golf club in his right hand, holding it along the shaft, and struck Portugues with the head of the club. Jeffrey said he was “agitated” because Portugues had dragged a tree limb downed in a windstorm that night into a parking lot, left it near a car belonging to Jeffrey’s girlfriend, and refused to move it.

“Two grown men acting like children,” Jeffrey testified.

Defense attorney Robert Viola argued that Jeffrey had the club to deter interference from another man who was behind him, but Parisi said he thought the other man may not have existed.
