NEWFANE – No one was smiling after a man painted over a smiley face and a sign that had been painted on a fence in the 3800 block of Ewings Road.

Niagara County sheriff’s deputies were called on Sunday following an argument between neighbors.

Donald P. Spillman, 61, of Ewings Road, told deputies that he had permission from his landlord to paint the fence, but the landlord denied the claim, saying he had not given him permission. The landlord further noted that the fence does not belong to him, but belongs to a neighbor who was given permission to put it up. He told deputies that the fence will now have to be “painted properly.”

Spillman was issued an appearance for criminal tampering, according to deputies.
