The State Supreme Court on Friday rejected an appeal by Sheridan Park and Amigone Funeral Home, which contended a grandfather clause by the State Legislature permitted the relocation of a crematory in the Town of Tonawanda.

The ruling upheld a decision made by the New York State Cemetery Board. Complaints by citizens about noise, odors and soot, and threatened action by State Attorney General Eric T. Schneiderman led to the 2012 closing of Amigone’s crematory at 2600 Sheridan Drive at Parker Blvd. Public opposition followed when Amigone considered moving the crematory first to 55 Cooper Ave. and then to the northwest corner of its property.
